Information notice for business partners whose personal data is processed in relation to the performance of contracts

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: “GDPR”), please be informed that:

 

  1. The Controller of your personal data is Jagiellońskie Centrum Innowacji Sp. z o.o. with its registered office in Krakow at the address: ul. Bobrzyńskiego 14, 30-348 Kraków, entered in the register of businesses of the National Court Register maintained by the District Court for Kraków – Śródmieście, 11th Commercial Division of the National Court Register with number KRS: 0000212725, NIP (tax identification number): 676-226-66-85 and REGON (statistical number): 356845374, with share capital of PLN 11,667,900.00 (hereinafter “Controller”). The Controller’s Data Protection Officer may be contacted by post at the Controller’s address or electronically via e-mail at iodo@jci.pl.
  2. Your personal data may be processed for the following purposes:
    • performance of a contract to which the data subject is a party or taking action at the request of the data subject prior to the conclusion of the contract (pursuant to Article 6(1b) of GDPR);
    • compliance with a legal obligation to which the Controller is subject in relation to the performance of contracts, recording payments, execution of projects, execution of orders (pursuant to Article 6(1c) of GDPR);
    • legitimate interests pursued by the Controller or by a third party (pursuant to Article 6(1f) of GDPR), i.e. protecting the Controller’s legal or financial interests, including, for example:
      • establishing, exercising or defending legal claims,
      • keeping correspondence,
      • creating analyses and statistics,
      • ensuring the safety of employees or property protection or production control or keeping information secret;
      • archiving;
    • keeping contacts in order to establish cooperation in the future based on your consent. At the end of this document, you can find the wording of the consent which covers the above. The consent can be included in the footnote of your offer.
  3. The following may be recipients of your personal data:
    • persons you have authorised – in the identified scope;
    • entities which render the services of providing technical solutions and organisational solutions for the Controller (e.g. providers of IT services, transport services, servicing, courier or postal services);
    • entities which provide legal services if it is necessary to assert claims (including courts or enforcement authorities) or financial services (e.g. banks);
    • entities authorised pursuant to generally applicable legal provisions;
    • entities authorised to carry out inspections, supervision or audits, including Jagiellonian University authorities or certification bodies;
    • entities which carry out scientific research;
  4. Your personal data will be stored for the period necessary for the purpose, until the termination of the applicable contract unless circumstances arise which determine keeping personal data longer (due to the specific purpose of processing); in the event of such circumstances the personal data will not be stored longer than until the expiration of claims or termination of proceedings or until the fulfilment of other legitimate interests of the Controller which are the basis of personal data processing.
  5. You have the right to request that you gain access to your personal data (pursuant to Article 15 of GDPR), that your personal data be rectified (pursuant to Article 16 of GDPR), that your personal data be erased (pursuant to Article 17 of GDPR), that the processing of your personal data be restricted (pursuant to Article 18 of GDPR), the right to personal data portability (pursuant to Article 20 of GDPR or by law) or the right to object to processing (pursuant to Article 21 of GDPR).
  6. You have the right to lodge a complaint with a supervisory authority pursuant to Article 77 of GDPR if you find that your personal data is processed by the Controller contrary to GDPR.
  7. You provide your personal data voluntarily. However, refusal to give your data will make it impossible to take any action with regard to the establishing of cooperation.

 

I consent to the processing of my personal data (first and last name, position, corporate e-mail and telephone number, name of the company I work for) given in the cooperation offer by Jagiellońskie Centrum Innowacji Sp. z o.o. in the CRM system database for marketing purposes.

 

I declare that I am aware that the consent is voluntary and I can withdraw it at any time (also partially) by notifying JCI thereof. If the consent is withdrawn, JCI will take the necessary steps in order to erase the data processed based on the withdrawn consent.”
